In this podcast we look at an overview of consent and capacity. We begin by looking at the three elements of consent - it must be informed, voluntary and the patient must have capacity to make the decision. Following this, we consider each in more detail looking at Montgomery v Lanarkshire (material risks) and look at the Mental Capacity Act 2005 in some detail in regards to each of the 5 principles, the two stage mental capacity test and best interests decisions. This overview is suitable for students and healthcare practitioners alike. Thanks for listening and there is loads more information on our website - https://www.healthcareethicsandlaw.co.uk/
