Bills S.2359/H.4096, “An Act promoting community immunity,” sponsored by Senator
Rausch + Representative Donato.

There are 2 bill numbers because the same bill (called a companion bill) was presented
on BOTH the Senate and the House sides, resulting in 2 bills (with the exact same
language)

This bill makes Religious and Medical exemptions more difficult to obtain & receive approval
from the Department of Public Health, gives minors the right to consent to preventative care
without parental consent or knowledge if the Doctor believes them to be mature enough or
believes it to benefit the child without age delineation nor provisions against those with learning
disabilities or IEPs, gives private schools the chance to set their own more-stringent

immunization requirements and able to discriminate on a religious basis, and creates an
“elevated risk” designation & reporting thereof for schools that fall below herd immunity.

This bill would eliminate religious exemptions, which can neither be approved or denied by the
(Department of Public Health) DPH, under current law. Medical exemptions would be the only exemption remaining. Currently,
per MGL CH 76, Section 15, the DPH has the final authority to approve or deny medical
exemptions. If the religious exemption is removed, then it will leave only the medical exemption,
which could be still denied by the DPH.

Allison presents a clear, cogent analysis of the exigent threat to personal freedoms, while discussing a rational alternative for vaccine research and legal reforms
