surfaces online. Today we're

we have a lot to cover today. We

do have a lot to cover and I feel like

I've already heard your thoughts on many of these cases

we're gonna be talking about because every time I turn

on the TV, there's Nima

telling me how, what he

thinks about the case already. So I'm glad that

we got a chance to have you on the

show again. Always appreciate

these conversations and always because I

feel like you

bring such a thoughtful perspective to the cases.

And one of them, the first one we're

3:13

gonna talk about is one that I know

3:15

that you've been following very closely. It

3:18

is involving a hip hop mogul

3:21

is facing additional allegations of sexual

3:23

misconduct as disturbing footage comes to

3:25

light, which appears to depict him

3:27

assaulting his then partner. Allegations

3:29

against Sean Diddy Combs have been

3:32

mounting since November of last year

3:34

when his former girlfriend Cassandra, also

3:36

known as Cassie Ventura, filed a

3:39

lawsuit accusing the entrepreneur of

3:41

a decade long pattern of sexual

3:43

and physical abuse. While the

3:46

lawsuit was ultimately settled a day

3:48

after the filing, additional alleged victims

3:50

filed lawsuits over the following months,

3:52

eventually culminating in a Homeland Security

3:54

raid on Diddy's homes in Miami

3:57

and Los Angeles as part of

3:59

a sex trafficking. investigation. Video

4:01

footage surfaced last week from an

4:03

incident at an LA hotel where

4:06

a towel-clad Diddy appears to chase down

4:08

Cassie, who has her bags packed, perhaps

4:10

in an attempt to escape, before the

4:12

rapper throws her to the ground, beating

4:15

and kicking the woman before dragging her

4:17

down a hallway. Diddy has

4:19

since issued an apology video regarding

4:22

the incident while he doesn't mention

4:24

Cassie's name in the video he

4:26

takes responsibility for the actions and

4:28

claims to be disgusted by his

4:31

behavior. However, in the

4:33

wake of the surveillance video

4:35

and apology, another accuser has

4:37

come forward claiming that Diddy

4:39

approached the then 17-year-old model

4:41

with enticements of furthering her

4:43

career before allegedly forcing her

4:45

to perform sex acts on

4:47

him. While lawsuits continue to

4:49

pile up against Diddy, he has not been

4:51

charged criminally and roundly rejects

4:53

the allegations leveled against him. Alright, that

4:56

was a mouthful. There's a lot going

4:58

on for Diddy. But first,

in regards to this last video, the DA's

5:02

office in Los Angeles has already come out

5:04

and said, Nima, that they are

5:06

closing the book and any kind of criminal filing

5:09

here because it's beyond the statute of limitations. My

5:11

question, though, is does that mean that that's

5:14

the end of Diddy's problems for this video

5:16

or do you think it could be used

5:18

in another way? Josh,

5:21

I think Diddy will be prosecuted. It's not

5:23

a matter of if but when. And I

5:25

do believe that video will be introduced to

5:27

evidence. And obviously, we both live

5:29

in Los Angeles, I live a mile away

5:31

from Diddy's home, very close to the Intercontinental

5:33

Hotel in Central City where this all took

5:35

place. But in California, at the

5:38

time 2016, we have three years statute on

5:41

felony assault and domestic violence. It

5:43

was recently extended to five years.

5:46

But even though the conduct

5:48

is outside the statute of limitations, we know

5:50

that clever prosecutors like you and I once

5:52

were can get this in. I think this

5:54

is what we would say is

5:56

prior bad acts evidence, right? It's been a

5:59

pattern of physical. and sexual violence in

6:01

the party did he? And we know that the

6:04

search warrant of his Los Angeles and Miami

6:06

homes, that was executed

6:09

by HSI agents, but it

6:11

was federal prosecutors at the US Attorney's

6:13

Office in the Southern District

6:15

of New York, who went and got those

6:17

search warrants. And we know that they also

6:19

love a good RICO indictment. You know, they

6:22

used an R. Kelly, they

6:24

used in other cases as well. And as

6:27

a RICO predicate act, you could use

6:29

conduct that's outside the statute. So I

6:31

wouldn't be surprised if an

6:34

indictment is unsealed, we see RICO charges.

6:36

And one of those predicate acts is

6:38

this physical assault and violence that we

6:41

saw. I'm so glad

6:43

that you brought that up about the predicate

6:45

acts in RICO, because that is something that

6:47

I think it's difficult for some people to

6:49

understand. We've talked on this channel

6:52

before oftentimes about prior

6:54

bad acts and how it doesn't matter

6:57

the statute of limitations. If you're

6:59

trying to prove something like in

7:01

this case, it would have to be

7:04

domestic violence, and you can show that

7:06

a person has prior acts of domestic

7:08

violence, you can use it. And in

7:10

fact, in California, you can use it even to show that

7:12

he has a predilection,

7:14

is predisposed to being someone

7:17

who commits acts of domestic

7:19

violence. But his bigger

7:21

problem, as you pointed out, is

7:23

the federal case, because he's being

7:25

federally investigated. And if they're gonna

7:27

bring some sort of RICO charge

7:31

or effort or theory, they

7:33

can use this as well in a very

7:35

similar way as a predicate act. Now, my

7:39

question is that raid took

7:42

place, we're going

7:44

on a couple of months now or more. Why

7:46

do you think it's taking so long? Do you

7:49

think, my feeling has always been

7:51

that that wasn't the beginning of an

7:53

investigation, that was towards the end of

7:55

an already ongoing investigation. But why do

7:57

you think they still have

7:59

not? indicted him. Josh,

I'm surprised. I agree with you. Federal prosecutors,

8:04

they don't get a search warrant until they're

8:06

close to the end. And this is why

8:09

people can take off, especially with people

8:11

with significant means like video. I'm not

8:13

saying that he's going to have scone,

8:15

but there's always that risk and evidence

8:18

can disappear. So you don't want

8:20

to execute a search warrant because

8:22

that's going to put someone on notice that they're

8:24

very likely going to get charged and charged soon.

So one of two things is going on here. Either

8:30

something was recovered from those raids that

8:32

they sort of push the prosecutors in

8:34

another direction. I think that's unlikely. There's

8:37

more and more victims and video evidence

8:39

are coming forward or for some

8:41

reason, they're still combing through the evidence that they

8:44

seized. Now, if you believe

8:46

Cassie Ventura, Diddy would record these

8:48

sex acts. She said that she

8:50

was forced to have sex with a male prostitute since

8:52

she was raped. Diddy would actually record

8:55

it himself. And there's also allegations that

8:57

hit cameras, some hidden and some not

8:59

throughout the home. So maybe agents are

9:01

still combing through that. But again,

9:04

I'm really at a loss that Diddy should have

9:06

been charged by now. I think it's a matter

9:08

of days or weeks until he is. This

9:11

video, which CNN did a great job of

9:13

getting, by the way, I mean, fantastic work.

Is this going to put more pressure on

9:18

prosecutors to act and to act soon? And

9:21

this is, it sounds like one of the worst

9:23

kept secrets in Hollywood. And, you know, it's

9:26

really a me too type situation. And I

9:28

really got to think that Diddy is going to be

9:31

charged and it's going to happen in a matter of

9:33

days or weeks. Yeah, I

9:35

agree with you. And I, I felt the

9:37

same way to two months ago when he

9:39

was first had those raids

9:42

executed, I thought to myself, they

9:44

they are the federal government is

9:46

media savvy enough to realize that

9:49

that kind of a public raid

9:51

on this high profile of a

9:53

person was going to

9:55

make the new circuit

spin And that they were going to. To

have some answers for what they were going

in there for and I thought okay, will

they They knew that they were going to

10:07

create a firestorm and that these charges are

going to becoming very quickly and then they

10:11

seven noticing. You know the government moves fairly

slowly so they could still be operating at

10:16

as you know, a quick pace by their

10:18

standards for we just haven't seen him. Yeah,

I think you make an excellent point that.

If there is a large

cache of electronics and. Computers.

And cell phones and other

media that needs cracking into.

That. Might be what's taking some of that

it's a traditional. Drug trafficking

Defense was especially since it's been over

being charged with Rico stateside there in

some folks think that Rico has

been overused, but you know, Federal

prosecutors. They love it for many

reasons. Is Sabrina lotta?

To finance a lot of evidence,

there's some seizures that can

happen as well as prejudgment self.

It's a pretty important investigative tools and

I wouldn't be surprised if that's what

we see in this case. It has.

visited the allegations on the civil

sites is You're looking at sexual

assault. You're looking at sexual abuse of

12:03

minors, right? And those

12:05

are not outside the statute of limitations. But

12:08

then you've got drugs. You've got guns.

And you have all these other people that at

12:12

least were alleged to have helped Diddy

12:15

perpetuate these sex crimes. And

12:18

whether it's Jeffrey Epstein and VLA Maxwell

12:20

or R. Kelly, you know, when you're

12:22

running an enterprise like

12:24

this, and

12:26

what possibly this is a criminal enterprise, there's

12:29

usually folks that are helping the perpetrator. And

12:31

that's what appears to be the case here.

Again, if you believe in the victims, which

I do. Yeah. Yeah.

And he also just in

12:40

the way that he conducted his business and

12:42

everything else, he was one of these people

12:44

that just had an entourage of folks helping

12:46

him. And I think he was operating in

12:48

a very different world back then that he

12:50

thought he was untouchable. And things

have changed, my friend. And the walls are closing

in. And I think I think the government's going

12:57

to become a knocking on your door any day

now. But we will keep an eye on it

more convincing but you mention Michael bought

an arm being. Respected.

The guys no slouch. I mean he's

been around for decades and consider to

be leader in his field. But do

is that all a problem because one

gregor is facing awesome clues it just

mere child abuse and not the death

itself do think that there might be

any convincing of them did this man

was awful he abused this but

you cannot connect his conduct to the

death of the child. It

would be really tough, Josh. I mean, you

know, let's kind of take a step back.

You know, again, the allegations were that, you

know, Corey's mother had a

drug problem, right? And Christopher wasn't

involved in his life

until very recently. I think he

was told about that he

20:23

was the biological father at age four, and I

20:26

think he got involved at age five. So maybe

20:28

about a year or so, that's

20:30

when the abuse started. And, you

20:32

know, there's

20:35

pneumonia and there's sepsis and there's infection,

20:38

and there's what happened to poor Corey, which is,

20:40

I mean, the things that you

20:42

see in murder cases, blunt force trauma and those

20:45

types of things. I don't think

20:47

any defense expert is going to be able

20:49

to pull the wool over the jury's eyes.

20:51

I mean, maybe there's some legal

20:54

Hail Mary and they maybe pick off one

20:56

jury and you get a hung jury. That's

20:58

always a possibility, but I would be

shocked in this case. Again, I just think

21:02

the video evidence is so powerful. I'm

21:05

kind of going back to Diddy. The example I give

21:07

is criminal defendants lie all the

21:09

time. Experts and lawyers can

21:11

try to see the jury, but you

21:14

know what doesn't lie? The video. And

21:16

there's a reason Diddy apologized after six

21:18

months when the video became public.

21:20

You know, for a while he was saying this

21:22

is a money grab. The victims

21:25

were looking for a payday, you know, all these sorts

21:27

of things. They were outrageous

21:29

lies. The video comes out.

21:31

He's forced to apologize. And I

21:33

think the same thing in,

21:36

you know, the Gregor case, the

21:38

video speaks for itself. It's so powerful.

I don't think the defense is

21:42

going to be able to overcome it.

I think you're right. I think

if they're at all having problems back there, they're

going to think about that video and

they're going to think, do we really want to

walk this guy out the door? Like they're the, You

know, When it air haven't

just don't see them to letting the person

who is willing to put a child through

that. Walk. Out the door. But

think sometimes defense attorneys, they get greedy. Like

I think in a case like this, it's

really your only defense, right? If

was watching a little bit of it. And

this man, first of all,

he's an absolute narcissist that comes through

clearly. I'm no psychologist, but I don't

think you need a degree to diagnose

that. But he also

is, has this inability, he

wants to control the situation entirely. And

at one point he was being cross-examined

and he didn't like the questions that

were coming out. And he felt like

he was being confronted with statements

that he was unaware of. And

attorney and the prosecutor says, sir,

to your attorney now. And he literally said,
