we're gonna be talking about because every time I turn

thinks about the case already. So I'm glad that

bring such a thoughtful perspective to the cases.

And one of them, the first one we're

gonna talk about is one that I know

that you've been following very closely. It

is involving a hip hop mogul

is facing additional allegations of sexual
3:23
misconduct as disturbing footage comes to
3:25
light, which appears to depict him
3:27
assaulting his then partner. Allegations
3:29
against Sean Diddy Combs have been
3:32
mounting since November of last year
3:34
when his former girlfriend Cassandra, also
3:36
known as Cassie Ventura, filed a
3:39
lawsuit accusing the entrepreneur of
3:41
a decade long pattern of sexual
3:43
and physical abuse. While the
3:46
lawsuit was ultimately settled a day
3:48
after the filing, additional alleged victims
3:50
filed lawsuits over the following months,
3:52
eventually culminating in a Homeland Security
3:54
raid on Diddy's homes in Miami
3:57
and Los Angeles as part of
3:59
a sex trafficking. investigation. Video

footage surfaced last week from an

incident at an LA hotel where
4:06
a towel-clad Diddy appears to chase down

Cassie, who has her bags packed, perhaps

in an attempt to escape, before the

rapper throws her to the ground, beating

and kicking the woman before dragging her

down a hallway. Diddy has

since issued an apology video regarding

the incident while he doesn't mention
4:24
Cassie's name in the video he

takes responsibility for the actions and
4:28
claims to be disgusted by his
4:31
behavior. However, in the
4:33
wake of the surveillance video
4:35
and apology, another accuser has
4:37
come forward claiming that Diddy
4:39
approached the then 17-year-old model
4:41
with enticements of furthering her
4:43
career before allegedly forcing her
4:45
to perform sex acts on
4:47
him. While lawsuits continue to
4:49
pile up against Diddy, he has not been
4:51
charged criminally and roundly rejects
4:53
the allegations leveled against him. Alright, that
4:56
was a mouthful. There's a lot going
4:58
on for Diddy. But first,

in regards to this last video, the DA's

office in Los Angeles has already come out

and said, Nima, that they are

closing the book and any kind of criminal filing

here because it's beyond the statute of limitations. My

question, though, is does that mean that that's

the end of Diddy's problems for this video

or do you think it could be used

in another way? Josh,

I think Diddy will be prosecuted. It's not

a matter of if but when. And I
5:25
do believe that video will be introduced to
5:27
evidence. And obviously, we both live
5:29
in Los Angeles, I live a mile away
5:31
from Diddy's home, very close to the Intercontinental
5:33
Hotel in Central City where this all took
5:35
place. But in California, at the
5:38
time 2016, we have three years statute on
5:41
felony assault and domestic violence. It
5:43
was recently extended to five years.

But even though the conduct
5:48
is outside the statute of limitations, we know
5:50
that clever prosecutors like you and I once
5:52
were can get this in. I think this
5:54
is what we would say is
5:56
prior bad acts evidence, right? It's been a
5:59
pattern of physical. and sexual violence in

the party did he? And we know that the
6:04
search warrant of his Los Angeles and Miami
6:06
homes, that was executed
6:09
by HSI agents, but it
6:11
was federal prosecutors at the US Attorney's
6:13
Office in the Southern District
6:15
of New York, who went and got those
6:17
search warrants. And we know that they also
6:19
love a good RICO indictment. You know, they
6:22
used an R. Kelly, they
6:24
used in other cases as well. And as
6:27
a RICO predicate act, you could use
6:29
conduct that's outside the statute. So I
6:31
wouldn't be surprised if an
6:34
indictment is unsealed, we see RICO charges.

And one of those predicate acts is
6:38
this physical assault and violence that we
6:41
saw. I'm so glad

that you brought that up about the predicate

acts in RICO, because that is something that
6:47
I think it's difficult for some people to
6:49
understand. We've talked on this channel
6:52
before oftentimes about prior
6:54
bad acts and how it doesn't matter
6:57
the statute of limitations. If you're
6:59
trying to prove something like in

this case, it would have to be
7:04
domestic violence, and you can show that
7:06
a person has prior acts of domestic
7:08
violence, you can use it. And in
7:10
fact, in California, you can use it even to show that
7:12
he has a predilection,
7:14
is predisposed to being someone
7:17
who commits acts of domestic
7:19
violence. But his bigger
7:21
problem, as you pointed out, is
7:23
the federal case, because he's being
7:25
federally investigated. And if they're gonna
7:27
bring some sort of RICO charge

or effort or theory, they
7:33
can use this as well in a very
7:35
similar way as a predicate act. Now, my

question is that raid took
7:42
place, we're going
7:44
on a couple of months now or more. Why

do you think it's taking so long? Do you
7:49
think, my feeling has always been

that that wasn't the beginning of an

investigation, that was towards the end of

an already ongoing investigation. But why do

you think they still have

not? indicted him. Josh,

I'm surprised. I agree with you. Federal prosecutors,

they don't get a search warrant until they're

close to the end. And this is why

people can take off, especially with people

with significant means like video. I'm not

saying that he's going to have scone,

but there's always that risk and evidence

can disappear. So you don't want

to execute a search warrant because

that's going to put someone on notice that they're

very likely going to get charged and charged soon.

So one of two things is going on here. Either

something was recovered from those raids that

they sort of push the prosecutors in

another direction. I think that's unlikely. There's

more and more victims and video evidence

are coming forward or for some

reason, they're still combing through the evidence that they

seized. Now, if you believe

Cassie Ventura, Diddy would record these

sex acts. She said that she

was forced to have sex with a male prostitute since

she was raped. Diddy would actually record

it himself. And there's also allegations that

hit cameras, some hidden and some not

throughout the home. So maybe agents are

still combing through that. But again,

I'm really at a loss that Diddy should have

been charged by now. I think it's a matter

of days or weeks until he is. This

video, which CNN did a great job of

getting, by the way, I mean, fantastic work.

Is this going to put more pressure on

prosecutors to act and to act soon? And

this is, it sounds like one of the worst

kept secrets in Hollywood. And, you know, it's

really a me too type situation. And I

really got to think that Diddy is going to be

charged and it's going to happen in a matter of

then you've got drugs. You've got guns.

And you have all these other people that at

least were alleged to have helped Diddy

perpetuate these sex crimes. And

whether it's Jeffrey Epstein and VLA Maxwell

or R. Kelly, you know, when you're

running an enterprise like

what possibly this is a criminal enterprise, there's

usually folks that are helping the perpetrator. And

that's what appears to be the case here.

Again, if you believe in the victims, which

the way that he conducted his business and

that just had an entourage of folks helping

think he got involved at age five. So maybe

when the abuse started. And, you

know, there's

pneumonia and there's sepsis and there's infection,

and there's what happened to poor Corey, which is,

I mean, the things that you

see in murder cases, blunt force trauma and those

types of things. I don't think

any defense expert is going to be able

to pull the wool over the jury's eyes.

I mean, maybe there's some legal

Hail Mary and they maybe pick off one

jury and you get a hung jury. That's

always a possibility, but I would be

shocked in this case. Again, I just think

the video evidence is so powerful. I'm

kind of going back to Diddy. The example I give

is criminal defendants lie all the

time. Experts and lawyers can

try to see the jury, but you

know what doesn't lie? The video. And

there's a reason Diddy apologized after six

months when the video became public.

You know, for a while he was saying this

is a money grab. The victims

were looking for a payday, you know, all these sorts

of things. They were outrageous

lies. The video comes out.

He's forced to apologize. And I

think the same thing in,

you know, the Gregor case, the

video speaks for itself. It's so powerful.

I don't think the defense is

going to be able to overcome it.
